These terms and conditions of sale are entered into on the one hand by the company ANITA & ZAHA with a share capital of €15555,55 whose registered office is located at 30 Boulevard du Doyenné, BP 40222-49100 Angers, registered with the Angers Trade and Companies Register under number 929 320 570, hereinafter referred to as “ANITA & ZAHA” and managing the ANITA & ZAHA website, https://anita-zaha.com/ and, on the other hand, by any natural or legal person wishing to make a purchase via the ANITA & ZAHA website, https://anita-zaha.com/hereinafter referred to as “the buyer”.
Article 1. Object
These terms and conditions of sale aim to define the contractual relationship between ANITA & ZAHA and the buyer, and the conditions applicable to any purchase made through the ANITA & ZAHA website, www.anita-zaha.com. Purchasing a product through this website implies the buyer's unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order.
Before any transaction, the buyer declares, on the one hand, that the purchase of products on the ANITA & ZAHA website, https://anita-zaha.com/is not directly related to his professional activity and is limited to strictly personal use and on the other hand has full legal capacity, allowing him to commit to these general conditions of sale.
ANITA & ZAHA reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.

Article 3. Prices
The prices listed on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. ANITA & ZAHA reserves the right to modify its prices at any time; however, the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, according to the total order amount. Delivery charges are determined by the weight of the package and the destination.
Article 4. Order and payment methods
Before placing any order, the buyer must create an account on the ANITA & ZAHA website, www.anita-zaha.com. The account creation section is accessible directly from the menu bar. ANITA & ZAHA offers the buyer the option to order and pay for their products in several steps, with a choice of payment options:
Payment by bank card: The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer based on their chosen carrier. Finally, the buyer selects their preferred payment method: "Payment by credit card."
We accept payments by Carte Bleue, Visa, MasterCard, Electron, Maestro, Vpay, American Express, and Bancontact. To make an online payment, please provide your card number, expiry date, and the three-digit security code on the back. Rest assured that the online payment process is secure. Payment by bank transfer : The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer based on their chosen carrier. Next, the buyer selects their preferred payment method: "Payment by bank transfer." Finally, the last step allows them to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation email. To finalize payment and initiate order processing, the buyer must contact their bank to transfer the order amount to the ANITA & ZAHA bank account, the details of which are provided to the buyer. Upon receipt of the transfer, the order will be processed, and the buyer will be notified by email. ANITA & ZAHA will ship the products no sooner than two business days after receiving the corresponding transfer, subject to availability.
Secure payment via PayPal or credit card (via PayPal): the buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer based on their chosen carrier. Next, the buyer selects their preferred payment method: "Payment via PayPal." The following step allows them to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button.
Finally, the buyer is redirected to the secure PayPal interface to safely enter their PayPal account or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed.
Payment via PayPal or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the payment, and the funds will then be credited back or refunded. The cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or 120 days if their contract with the bank stipulates this extension. The bank will refund the debited amounts within a maximum of one month after receiving the cardholder's written dispute. The cardholder will not be charged any fees for the refund.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgment of having full knowledge thereof and waiver of any right to invoke one's own terms and conditions of purchase.
All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on their order form, ANITA & ZAHA will send them an email confirming their order.

Article 5. VAT
In accordance with applicable European Union legislation, we apply the VAT rate applicable in the Member State from which the goods are shipped or the services are provided. For detailed information on VAT rates in Europe, we recommend consulting the official website of the European Commission and the websites of national tax authorities.
Delivery to a country outside the European Union: products are invoiced excluding taxes, which excludes the application of 20% VAT. Customs duties may be levied upon delivery.
Article 6. Retention of title
The company ANITA & ZAHA retains full and complete ownership of the products sold until full payment of the price, including principal, fees and taxes.
Article 7. Delivery
Deliveries are made to the address provided when ordering, within the geographical area served by ANITA & ZAHA. All shipments are handled by La Poste via the Colissimo service, with delivery to the mailbox when possible, or against signature, both in France and internationally.
Each package is tracked, and the tracking number is sent to the buyer by email upon shipment. Delivery times are estimates only. If delivery is not made within thirty (30) days of order confirmation, the sales contract may be cancelled and the buyer refunded.
If the recipient is absent and the package cannot be delivered to the mailbox, a delivery notice will be left by the postal service. The buyer can then collect their package from the post office or a collection point, according to the Colissimo terms and conditions.
The risks associated with shipping are transferred to the buyer upon delivery of the package to the postal service. It is the buyer's responsibility to check the condition of the package upon receipt and to report any damage to the carrier within three (3) business days.
Article 8. Processing fees:
For each order, a fixed processing fee of €0,00 (excluding VAT) is applied to all ANITA & ZAHA customers. This fee covers the costs associated with order preparation, including packaging, tissue paper, bubble wrap, and quality boxes, to ensure optimal product protection and a pleasant customer experience.
Article 9. Conditions of the free delivery offer
ANITA & ZAHA offers free delivery under the following conditions:
For France, Monaco and Andorra: Free delivery for any order where the subtotal excluding tax (HT) is from €23,33 HT.
For Austria, Luxembourg, Spain, Belgium, the Netherlands and Portugal: Free delivery for any order whose subtotal excluding tax (HT) is from €23,33 HT and €28 incl. VAT.
For all member countries of the European Union, Norway, Gibraltar, Holy See (Vatican City State), Switzerland, Liechtenstein and the United Kingdom: Free delivery for any order whose subtotal excluding tax (HT) is from €23,33 HT and €28 incl. VAT.
For all of the following countries: Canada, United States, Hong Kong, Taiwan, Brazil, Chile, Mexico, Panama, Saudi Arabia, Bahrain, Israel, Oman, United Arab Emirates, India, Japan, Kuwait, Singapore, South Korea, New Zealand, Australia, Indonesia, Morocco and Egypt, delivery is free from €95 excluding VAT purchase.
Free delivery is provided by Mondial Relay for destinations where this service is available. For Monaco, Andorra, and countries where Mondial Relay is not available, ANITA & ZAHA will ship packages via La Poste – Colissimo or another suitable transport provider.
ANITA & ZAHA reserves the right to modify or withdraw this offer at any time. Any changes will be communicated to customers through the appropriate channels (website, terms and conditions of sale, direct communication).
By accepting this offer, the customer acknowledges that when delivery is free, the choice of carrier is at the discretion of ANITA & ZAHA and cannot be imposed by the customer.
Article 10. Right of withdrawal
In accordance with Article L221-18 of the French Consumer Code, the buyer has 14 calendar days from receipt of their order to exercise their right of withdrawal without having to provide a reason or pay any penalties, except for return shipping costs. To exercise their right of withdrawal, the buyer must clearly and explicitly notify their decision in writing. This notification must be sent by email to customer service at the following address: serviceclients@anita-zaha.com, specifying:
- Email Title: Cancellation Request for Order [Order Number]
- His name and contact details.
- The order number and its date.
- A statement clearly expressing his intention to retract.
Once the right of withdrawal has been exercised, the buyer has an additional 14 days to return the products to the seller.

Returned products (in good condition, unopened and unused) must be eligible for exchange or refund.
Any product that is damaged, incomplete, or shows signs of use will not be accepted.
Article 11. Conditions and deadlines for reimbursement
The refund for returned products (in good condition, unopened and unused) under the right of withdrawal will be made in full, subject to their compliance with the conditions set out in article 8.
This refund will be made by bank transfer as soon as possible and at the latest within 30 days of receipt of the returned products or the exercise of the right of withdrawal, in accordance with Article L221-24 of the Consumer Code.
Article 12. Legal Guarantee and Liability
You benefit from the legal guarantee of conformity, as stipulated in Article L211-4 of the Consumer Code, which states that "The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery."
This guarantee applies to our new products that have defects, whether they are damaged, broken or altered during transport, even in the absence of an explicit contractual guarantee.
In the event of non-conformity or defect, we undertake to replace your product or issue a refund as soon as possible.
In accordance with Article 1147 of the French Civil Code, we are fully liable to you for any breach or improper performance of the contract. However, our contractual liability shall not be incurred in the following cases: in the event of force majeure as defined by French case law; due to an external event beyond our control; or in the event of improper use of our products.

In the event of a dispute between the Client and the company, they will endeavor to resolve it amicably (the Client will send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).

Article 18. Litigation
Sales of ANITA & ZAHA products are governed by French law, regardless of the Buyer's country of residence or the location of the order. In the event of a dispute concerning the existence, interpretation, performance, or termination of the contract between ANITA & ZAHA and the Buyer, even if multiple defendants are involved, exclusive jurisdiction shall be granted to the competent French courts, in accordance with the provisions of the French Code of Civil Procedure, in the absence of an amicable settlement.
